General Terms and Conditions of Business and Use – Die Pfenninger Alm
As of: October 2026
1. Operator and scope
1.1 Operator
The Pfenninger Alm is operated by Pfenninger Alm GmbH, Oberaustraße 33a, 5071 Wals/Siezenheim, Salzburg, Austria, represented by managing director Patrick Gaspar (hereinafter the “Operator” or “we”). Company register number: FN 646276G, commercial court: Landesgericht Salzburg, VAT ID: ATU 81711248. Full details can be found in our legal notice.
1.2 Scope
These terms apply to all services and contracts of the Operator in connection with the Pfenninger Alm, in particular to:
- restaurant and garden operations,
- events and live music,
- private parties and company parties (“Parties at the Alm”),
- table reservations, including via our website (online table reservation),
- vouchers,
- deliveries by suppliers to the Pfenninger Alm,
- use of our website.
1.3 Definitions
“Guests” are all persons who visit the Pfenninger Alm or use our services. “Customers” are persons or companies that enter into a contract with us, for example for a reservation or a party. “Consumers” and “entrepreneurs” are to be understood within the meaning of the Austrian Consumer Protection Act (KSchG).
1.4 Agreements
Individual agreements take precedence over these terms. We recommend recording arrangements – especially for parties – in writing (for example by email) so that both sides have clarity. Deviating terms and conditions of customers or suppliers only apply if we expressly agree to them.
1.5 Wording
These terms are worded in a gender-neutral way and are addressed equally to everyone.
2. Use of the website and copyright
2.1 Website content
We create the content of our website with the greatest possible care. It serves general information purposes only. We cannot guarantee the completeness, accuracy or topicality of the content – for example opening hours, menus, prices or event dates. Information on site and in our respective confirmation or offer is binding.
2.2 Copyright
All images, texts and other content of this website are protected by copyright. All rights are reserved to the Operator or the respective authors.
- Image and video material: © Thomas Genser (www.thomasgenser.com)
- Design and concept: © Pia Platzbecker
Any reproduction, distribution or other use of the content is only permitted with the prior written consent of the respective rights holders.
3. Online table reservation
3.1 Reservation and confirmation
You can reserve a table via our website, by telephone or by email. A reservation is only binding once we have confirmed it; for online reservations you receive the confirmation by telephone or by email. The automatic acknowledgement of receipt from our website is not yet a confirmation. Please check the details in the confirmation (date, time, number of guests) and contact us if anything is incorrect.
3.2 Late arrival
We hold reserved tables for 15 minutes beyond the agreed time. If you have not arrived by then and have not informed us, we may give the table to other guests. If you are running late, please give us a quick call on +43 660 4461554.
3.3 Changes and cancellation
Please tell us about changes or cancellations of a free reservation as early as possible by telephone, by email or via the cancellation link in the email about your reservation. That way we can offer the table to other guests.
3.4 Reservation fee
Online reservations via our website are currently free of charge. Should we charge a reservation fee for certain times or events, we will clearly point out the amount and the conditions (deduction or voucher, cancellation deadline, retention in case of no-show) before you complete the reservation; these conditions are then described here.
3.5 No right of withdrawal for online reservations
Please note: for contracts for services connected with leisure activities and for the supply of food and drink for which a specific date or period has been agreed, there is no statutory right of withdrawal under § 18 (1) no. 10 of the Austrian Distance and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz, FAGG). Your option to cancel under point 3.3 remains unaffected.
4. Vouchers
4.1 Redemption
Pfenninger Alm vouchers can be redeemed during opening hours for food and drinks and for parties at the Alm. Please present the voucher (voucher code or printout) before paying. Partial redemption is possible; any remaining amount stays as credit.
4.2 Validity
Vouchers are valid for 3 years from the date of issue. The date of issue is stated on the voucher or in the email containing the voucher code.
4.3 Cash redemption and loss
Vouchers cannot be redeemed for cash. We cannot replace lost or stolen vouchers unless the voucher is clearly assigned to one person and has not yet been redeemed.
4.4 Online purchase of vouchers
You can order vouchers on our website. You choose the value from the amounts offered or (within the limits shown) freely. Payment is made by bank transfer or on site; you will receive the payment details after ordering and by email. The voucher only becomes valid once payment has been received: we then send you the voucher code by email or – if you have chosen handover at the Alm – keep the printed voucher ready for collection. Orders that are not paid do not result in a valid voucher. Statutory rights of withdrawal of consumers in distance contracts remain unaffected.
5. Parties at the Alm
5.1 Enquiry, offer and conclusion of contract
For private and company parties of up to 40 guests we will gladly prepare an offer on request. Our offers are non-binding until you accept them. The contract is concluded with our written confirmation (e.g. by email). The content of the confirmation determines the scope of the agreed services.
5.2 Services and prices
The specific services and prices result from the respective offer. Currently we offer, among other things (as of October 2026, prices incl. VAT):
- Reindl menus on request,
- cakes brought along: plate fee of €7.50 per cake,
- Augustiner keg: 15 litres at €145, 25 litres at €210.
5.3 Number of guests and changes
Please let us know the final number of guests no later than 7 days before the party. This number is the basis for preparation and billing. We are happy to fulfil requests for additional or changed services as far as we are able; they are charged separately.
5.4 Decoration and music
Your own decoration is welcome. Please agree larger decorations with us in advance and do not use materials that could damage furnishings or the building. Atmosphere music is possible from 22:00.
5.5 Own programme items and permits
If you would like to bring your own musicians, DJs or other programme items, please agree this with us in advance. Unless otherwise agreed, you are responsible for any permits and registrations required for such programme items.
5.6 Deposit and payment
For parties we may request a reasonable deposit, which will be stated in the offer. Unless otherwise agreed, the remaining amount is to be paid on site at the end of the party. In case of late payment, statutory default interest applies.
5.7 Cancellation by the customer
You can cancel a confirmed party at any time. Please notify us of the cancellation in writing (e.g. by email). The following cancellation fees apply, each based on the agreed total price:
- up to 14 days before the party: free of charge,
- from 13 to 3 days before the party: 50%,
- from 2 days before the party or in case of no-show: 100%.
You are free to prove that we have suffered no damage or a substantially lower damage. We will deduct expenses saved.
5.8 Force majeure and withdrawal by the Operator
If a party cannot take place for reasons of force majeure (e.g. severe weather, official orders), both sides may withdraw from the contract free of charge; we will refund any payments already made. We may also withdraw from the contract if an agreed deposit is not paid despite a reminder or if there is an important reason, for example if the party significantly endangers the operation, safety or reputation of the Pfenninger Alm.
5.9 Passing on
Passing on or subletting the booked rooms or areas to third parties is not permitted without our consent.
5.10 Damage and cleaning
You are liable under the statutory provisions for damage culpably caused by you or your guests. Usual cleaning is included in the price. In case of exceptional soiling (e.g. confetti or glitter) we may charge the additional cleaning effort appropriately.
6. Events and live music
6.1 Admission
An entrance fee may be charged for individual events. We point this out in the announcement.
6.2 Cancellation and programme changes
If we have to cancel an event, we will refund an entrance fee already paid. We reserve the right to make minor programme changes (e.g. changes to the schedule or start times) as far as they are reasonable for you. Any further claims, for example for reimbursement of travel or other costs, exist only within the scope of our liability under section 8.
6.3 Volume
Live music and events can be loud. Please take care of your own hearing protection and that of your children.
6.4 Photo and video recordings
At events, photos and videos may be taken which we use for our website and our social media channels. We point out such recordings on site. If you do not wish to be photographed or filmed, please tell our team or the person taking the pictures. You may also object afterwards to the publication of recordings in which you are recognisable; we will then remove the recordings concerned as far as possible. You can find more information in our privacy policy.
Guests’ own recordings are permitted for private purposes. Please respect the privacy of other guests and our team. Professional or commercial recordings require our prior consent.
6.5 Admission and bag checks
At larger events, admission and bag checks may be carried out for the safety of all guests. A check is only carried out with your consent. If you refuse a check, we may deny you entry to the event. For age checks, an official photo ID may be requested.
7. House rules
7.1 General
Please treat our facilities and the premises with care and only enter areas that are accessible to guests. After closing time or the end of the event we ask you to leave the premises.
7.2 Safety
Instructions from our staff, in particular regarding safety, must be followed.
7.3 Violence and harassment
Violence, threats, harassment and discriminatory behaviour have no place here. In such cases we may remove persons from the premises and issue a ban. We report criminal acts.
7.4 Alcohol, drugs and youth protection
The youth protection regulations of the Province of Salzburg apply. We only serve alcoholic beverages to persons who have reached the legal minimum age; we may ask for proof of age. We may refuse entry or further service to heavily intoxicated persons or persons under the influence of drugs. Possession and consumption of illegal substances is prohibited.
7.5 Food, drinks and items brought along
Bringing your own food and drinks is not permitted. Exceptions are cakes at parties at the Alm by arrangement (plate fee see section 5.2). Dangerous items such as weapons, fireworks and pyrotechnics must not be brought. Further restrictions may apply at events (e.g. glass bottles), which we point out in the announcement or on site. If we suspect illegal items, we will notify the police.
8. Liability
8.1 Liability of the Operator
We are liable without limitation for damage that we cause intentionally or through gross negligence, and for personal injury (injury to life, body or health). We are not liable towards entrepreneurs for other damage caused by slight negligence. Towards consumers we are not liable for property damage caused by slight negligence. Mandatory statutory liability provisions, for example under the Product Liability Act, remain unaffected.
8.2 Cloakroom and valuables
Statutory provisions apply to liability for cloakroom items and valuables brought along. Please do not leave valuables unattended.
8.3 Liability of guests
Guests and customers are liable under the statutory provisions for damage they culpably cause.
9. Suppliers
9.1 Applicability
The following provisions apply, in addition to the respective delivery agreements, to entrepreneurs who deliver goods to the Pfenninger Alm or provide services there (hereinafter “Suppliers”).
9.2 Delivery and unloading
Delivery takes place at the times agreed with us and exclusively at the location we designate. Unloading is the responsibility of the suppliers; we do not provide staff or equipment for unloading unless otherwise agreed.
9.3 Incorrect unloading
If goods are unloaded at a location not designated, we may charge the costs of relocating them as well as reasonable compensation for expenses.
9.4 Acceptance
Acceptance of the goods is confirmed on the delivery note or an acceptance report. Recognisable defects and damage must be recorded there. Defects that were not noted are presumed, in case of doubt, to have been present at acceptance; we report hidden defects as soon as they become recognisable.
9.5 Damage
Suppliers are liable under the statutory provisions for damage that they or their employees cause on the premises of the Pfenninger Alm during delivery. Such damage must be reported to us without delay. Our liability towards suppliers is excluded in case of slight negligence and limited to €2,000 per case of damage in case of gross negligence; this does not apply to intent or personal injury.
9.6 Recordings on the premises
Photo and video recordings on the business premises by suppliers are only permitted with our prior consent.
10. Data protection
We process personal data – for example for reservations, party enquiries or photo and video recordings at events – in accordance with the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act. Detailed information on purpose, legal basis, storage period and your rights can be found in our Privacy policy.
11. Dispute resolution
If you have questions or complaints, please contact us directly first – we are happy to find a solution together.
12. Applicable law, jurisdiction and set-off
Austrian law applies, excluding the conflict-of-law rules of private international law and the UN Convention on Contracts for the International Sale of Goods. Towards consumers, this choice of law only applies insofar as it does not restrict mandatory protective provisions of the state in which they have their habitual residence.
For consumers, the mandatory statutory places of jurisdiction apply. For entrepreneurs, the exclusive place of jurisdiction is the court with subject-matter jurisdiction for Salzburg.
Entrepreneurs may only set off counterclaims against our claims that have been acknowledged by us or finally established by a court.
13. Severability clause
Should a provision of these terms be or become invalid, the remaining provisions remain unaffected. Towards entrepreneurs, the invalid provision is replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
